我們平台主要於台灣、香港、新加坡及馬來西亞等地區提供服務,並依各該地區適用之個人資料保護相關法令(包括但不限於台灣個人資料保護法、香港個人資料(私隱)條例、新加坡個人資料保護法、馬來西亞個人資料保護法)蒐集、處理及利用您的個人資料。
在使用我們的產品或服務前,請您務必仔細閱讀並充分理解本隱私政策。在確認充分理解並同意後使用相關產品或服務。本隱私政策中涉及的專業詞彙,我們盡量以簡明通俗的表述向您解釋,以便於您理解。如對本隱私政策內容有任何疑問、意見或建議,您可通過本隱私政策文末的聯繫方式與我們聯繫。
您同意本政策表示您已經了解並同意在相關場景下,為實現功能運行,我們將對您的相關個人信息進行處理。但這並不代表只要您開始使用我們的產品與/或服務,我們將處理本政策中涉及的全部個人信息。僅當您使用特定功能時,我們才會根據「最小必要」原則,為實現向您提供服務的目的,處理您的相關個人信息。
除本隱私政策外,在特定場景下,我們還會通過即時告知(含彈窗、站內信等)、功能更新說明等方式,向您說明對應的信息收集目的、範圍及使用方式,這些即時告知及功能更新說明構成本隱私政策的一部分,並與本隱私政策具有同等效力。
本政策及相關網路服務由我們提供,作為我們搜集、處理及利用您提供予我們個人資料之準則。本政策適用於您在我們所提供的服務時,我們在為您提供服務期間可能涉及到的個人資料搜集、處理、利用、國際傳遞以及保護措施。本政策不適用於經我們的服務而連結至第三人經營的網站、App,亦無法控制該等其他網站的活動。
一、搜集的目的及方式

我們公司之搜集目的在於履行與您的用戶協議、為您註冊使用 APP 之服務、線上交易、線上活動、進行行銷服務、客戶管理、內部的統計調查與分析、用戶管理及其他合於營業登記項目或章程所定業務之需要。請您提供正確的個人資料,所有關於您的個人資料之欄位請務必確實填寫。若您無法提供真實且完整的個人資料,將有可能影響我們與您的聯繫、完成交易、提供服務、身份驗證或處理消費、交易或客訴問題,建議您隨時留意並更新個人資料。若因您未提供完整且正確之個人資料,造成對您及第三人發生損害時,您應自行負擔一切責任;如未來因不實資料發生爭議(例如偽冒身份)時,我們將視狀況依法追訴您的犯罪行為;如因此造成我們損失時,我們將有權向您請求損害賠償。
2. 我們通過如下方式搜集您的個人資料
(1) 由您透過帳號或產品註冊、契約、用戶協議、各項服務表單填寫或訂購單填寫等方式進行。您可自行選擇是否提供資料,但某些網站功能、服務或活動必須根據您所提供的資料方得使用時,您若不提供完整而正確的個人資料,部分服務、網站功能或活動可能無法使用。

二、我們如何共享、轉讓、公開披露個人信息
(一)如何共享個人信息
我們不會與產品服務相關提供者以外的公司、組織和個人共享您的個人信息。我們可能會與合作夥伴共享您的某些個人信息,以提供更好的客戶服務和用戶體驗。我們僅會出於合法、正當、必要、特定、明確的目的共享您的個人信息,並且只會共享提供服務所必要的個人信息,具體情況如下:
1. 在獲取明確同意的情況下共享:在獲得您的明確同意後,我們會與其他方共享您的個人信息。
2. 在法定情形下的共享:我們可能會根據法律法規規定、訴訟爭議解決需要,或按行政、司法機關依法提出的要求,對外共享您的個人信息。

- 地理位置服務:當您使用地理位置相關服務時,我們會通過 SDK 或相關技術將 GPS 信息與位置服務提供商進行共享以便可以向您返回位置結果。GPS 信息是個人敏感信息,拒絕提供,僅會影響地理位置服務功能,但不影響其他功能的正常使用。
- 幫助您參加營銷推廣活動:當您選擇參加我們及我們的關聯方或第三方舉辦的有關營銷活動時,可能需要您提供姓名、通信地址、聯繫方式、銀行賬號信息。其中部分信息是個人敏感信息,拒絕提供可能會影響您參加相關活動,但不會影響其他功能。只有經過您的同意,我們才會將這些信息與關聯方或第三方共享,以保障您在聯合活動中獲得體驗一致的服務,或委託第三方及時向您兌現獎勵。
4. 用戶主動的共享:我們產品的多項服務可讓您不僅與您的社交網絡,也與使用該服務的所有用戶公開分享您的相關信息,例如,您在產品中所上傳或發布的信息(包括您公開的個人信息、您建立的名單)、您對其他人上傳或發布的信息作出的回應,以及包括與這些信息有關的位置數據和日誌信息。使用我們服務的其他用戶也有可能分享與您有關的信息(包括位置數據和日誌信息)。特別是產品的社交媒體服務,是專為使您可以與世界各地的用戶共享信息而設計,從而使共享信息可實時、廣泛地傳遞。只要您不刪除共享信息,有關信息便可能一直留存在公眾領域;即使您刪除共享信息,有關信息仍可能由其他用戶或不受我們控制的非關聯第三方獨立地緩存、複製或儲存,或由其他用戶或該等第三方在公眾領域保存。您在我們的服務中所提供、上傳或發布的內容和信息(例如有關您社交活動的照片或信息),可能會泄露您的敏感個人信息。您需要謹慎地考慮,是否使用我們的服務披露您的敏感個人信息。

(二)如何轉讓個人信息
我們不會將您的個人信息轉讓給任何公司、組織和個人,但以下情況除外:

1. 獲得您明確同意後;
2. 基於法律的披露:在法律、法律程序、訴訟或政府主管部門強制性要求的情況下,我們可能會公開披露您的個人信息;
3. 對違規賬號、欺詐行為進行處罰公告。
(四)免征得同意共享、轉讓、公開披露的個人信息
根據法律法規及國家標準,我們在下列情形中,共享、轉讓、公開披露您的個人信息無需征得您的授權同意:
1. 與國家安全、國防安全直接相關的;
2. 與公共安全、公共衛生、重大公共利益直接相關的;
3. 與犯罪偵查、起訴、審判和判決執行等直接相關的;
4. 出於維護您或其他個人的生命、財產等重大合法權益但又很難得到您的同意的;
5. 您自行向社會公眾公開的個人信息;

三、我們如何保護個人信息
本政策提供的如下個人信息保護措施僅適用於我們的產品。一旦您離開我們的產品,瀏覽或使用其他網站、服務及內容資源,我們即沒有能力及義務保護您在我們的產品之外的軟件、網站提交的任何個人信息,無論您登錄、瀏覽或使用上述軟件、網站是否基於我們的產品的鏈接或引導。
(一) 為保障您的信息安全,我們致力於使用各種安全技術及配套的管理體系來盡量降低您的信息被泄露、毀損、誤用、非授權訪問、非授權披露和更改的風險。我們會采取一切合理可行的措施,保護您的個人信息。例如:
1. 在您的設備與「產品服務」之間交換數據時受 SSL 加密保護;
2. 我們會使用加密技術確保數據的保密性;
3. 我們會使用受信賴的保護機制防止數據遭到惡意攻擊;
4. 我們會部署訪問控制機制,確保只有授權人員才可訪問個人信息;
5. 我們會舉辦安全和隱私保護培訓課程,加強員工對於保護個人信息重要性的認識;
6. 我們認為其他的合理可行的保護措施。
(二) 我們會建立專門的安全部門、安全管理制度、數據安全流程保障您的個人信息安全。我們采取嚴格的數據使用和訪問制度,確保只有授權人員才可訪問您的個人信息,並及時對數據和技術進行安全審計。
(三) 我們會使用不低於行業同行的加密技術、匿名化處理等合理可行的手段保護您的個人信息,並使用安全保護機制防止您的個人信息遭到惡意攻擊。
(四) 我們會采取一切合理可行的措施,確保未收集無關的個人信息。
(五) 互聯網並非絕對安全的環境,而且即時通訊及與其他用戶的交流方式並未加密,我們強烈建議您不要通過此類方式發送個人信息。請使用複雜密碼,協助我們保證您的賬號安全。請您務必妥善保管好您的產品登錄名及其他身份要素。您在使用產品時,我們會通過您的登錄名及其他身份要素來識別您的身份。一旦您泄漏了前述信息,您可能會遭受損失,並可能產生對您不利的法律後果。如您發現產品登錄名及/或其他身份要素可能或已經泄漏時,請您立即和我們聯繫,以便我們及時采取相應措施以避免或降低相關損失。
(六) 我們將不定期更新並公開安全風險、個人信息安全影響評估等報告的有關內容。
(七) 互聯網環境並非百分之百安全,我們將盡力確保或擔保您發送給我們的任何信息的安全性。如果我們的物理、技術或管理防護設施遭到破壞,導致信息被非授權訪問、公開披露、篡改或毀壞,導致您的合法權益受損,我們將承擔相應的法律責任。
(八) 在不幸發生個人信息安全事件後,我們將按照法律法規的要求,及時向您告知:安全事件的基本情況和可能的影響、我們已采取或將要采取的處置措施、您可自主防範和降低風險的建議、對您的補救措施等。我們將及時將事件相關情況以郵件、電話、推送通知等方式告知您,難以逐一告知個人信息主體時,我們會采取合理、有效的方式發布公告。我們還將按照監管部門要求,主動上報個人信息安全事件的處置情況。
四、您的權利
(一)訪問您的個人信息
您有權訪問您的個人信息,法律法規規定的例外情況除外。如果您想行使數據訪問權,可以通過以下方式自行訪問:
賬號信息——如果您希望訪問或編輯您賬號中的個人資料信息等,您可以通過產品客戶端應用程序中相應功能執行相應操作。
如果您無法通過上述方式訪問個人信息,您可以使用客服電話、發送電子郵件或在線客服等方式聯繫我們。我們將在十五個工作日內回覆您的訪問請求。
(二)更正您的個人信息
一般情況下,您可以直接瀏覽、修改、刪除自己提交的信息。但出於安全性和身份識別的考慮,您可能無法自主修改註冊時提交的某些初始註冊信息;如您確有必要修改該類信息,您可以使用客服電話、發送電子郵件或在線客服的方式提出更正申請,我們將盡快審核所涉問題,並由專人驗證您的用戶身份後及時予以回覆。
(三)刪除您的個人信息
在以下情形中,您可以向我們提出刪除個人信息的請求:
1. 如果我們處理個人信息的行為違反法律法規;
2. 如果我們收集、使用您的個人信息,卻未征得您的同意;
3. 如果我們處理個人信息的行為違反了與您的約定;
4. 如果您不再使用我們的產品或服務;
5. 如果我們不再為您提供產品或服務;
6. 其他。
如您申請刪除您的部分個人信息,可能影響該部分信息所對應的相關服務,但不會影響使用產品的其他基本功能。您可通過人工客服等方式向我們反饋您的其他刪除個人信息的需求。若我們決定響應您的刪除請求,我們還將同時通知從我們獲得您的個人信息的實體,要求其及時刪除,除非法律法規另有規定,或這些實體獲得您的獨立授權。
當您從我們的服務中刪除信息後,我們可能不會立即在備份系統中刪除相應的信息,但會在備份更新時刪除這些信息。
(四)投訴舉報
您可以按照我們公示的制度進行投訴或舉報。如果您認為您的個人信息權利可能受到侵害,或者發現侵害個人信息權利的線索,您可以通過如下途徑進行舉報,我們核查後會在十五個工作日內反饋您的投訴與舉報:
1. 在「幫助和反饋」界面,點擊在線客服與我們聯繫;
2. 通過郵件或客服電話與我們聯繫。
五、政策的修訂
在相關法令的要求下,我們保留隨時修訂本政策之權利。當我們的個人資料搜集、處理、利用作出修改時,我們會更新本網頁內容,並將修改後的政策條款公告於網站或應用內,同時以公告或電子郵件方式通知所屬全體會員。請您密切留意以保障個人權益。

SONAR / QIAN YING ENTERPRISE (hereinafter "we" or "us") is the developer and operator of YaY Live (hereinafter "our Platform"), and attaches great importance to user privacy and personal information protection. We understand the importance of personal information to you and will do our best to protect the security of your personal information. When you use our products or services, we may collect and use your relevant information. We hope to explain to you, through the YaY Live Privacy Policy (hereinafter "this Privacy Policy"), how we collect, use, and protect this information when you use our products or services. 2. How We Share, Transfer, and Publicly Disclose Personal Information
(1) How to Share Personal Information
We will not share your personal information with companies, organizations, or individuals other than product service providers. We may share some of your personal information with partners to provide better customer service and user experience. - Geographic Location Services: When you use location-related services, we will share GPS information with location service providers through SDK or related technologies so that we can return location results to you. GPS information is personal sensitive information. Refusal to provide it will only affect the geographic location service function, but will not affect the normal use of other functions.
- Help you participate in marketing activities: When you choose to participate in marketing activities organized by us, our affiliates, or third parties, you may need to provide your name, mailing address, contact information, and bank account information. Some of the information is personal sensitive information, and refusing to provide it may affect your participation in related activities, but it will not affect other functions. Only with your consent can we share this information with related parties or third parties to ensure that you receive a consistent service experience in joint activities, or entrust third parties to timely deliver rewards to you.
